Professor Gary Lawson explains that cases that can be decided on a purely originalist basis are few and far between. Most issues have years worth of precedents that have to be considered and most judges will take those into consideration. This is why we don’t see a dramatic shift in decisions even when originalist judges are added to a court.
Professor Gary Lawson is the Philip S. Beck Professor at Boston University School of Law.
As always, the Federalist Society takes no position on particular legal or public policy issues; all expressions of opinion are those of the speaker.
