For many federal prisoners, the real damage didn’t happen at trial - it happened at sentencing.
In the federal system, sentences are often not fixed when you plead guilty. Instead, they are determined later under the United States Sentencing Guidelines. If your attorney failed to properly review, object to, or challenge errors in your pre-sentence investigation report (PSR), that mistake could have added years to your sentence
In this video, Board-Certified Criminal Law and Criminal Appeals Specialist Jacob Blizzard explains how ineffective assistance of counsel can occur during federal sentencing. From incorrect guideline calculations and career offender enhancements, to wrong drug quantities, misapplied criminal history points, or missed mitigation opportunities — these errors happen more often than people realize.
The majority of federal cases never go to trial. That means sentencing is where many cases go wrong. And unlike trial errors, sentencing mistakes can sometimes be identified by carefully comparing your PSR to the Sentencing Guidelines that were in effect at the time of your conviction
If you received far more time than you expected, or something about your guideline calculation doesn’t feel right, you are not alone. There may still be a path to challenge it through a 2255 motion.
Take the time to review your PSR. Compare it to the guidelines. Ask questions. A careful review today could potentially mean years off your sentence tomorrow.
