If a skilled doctor has taken care of this disease, and he is one of his family, from the treatment, he has mastered it, learned in it, and is considered one of the people of treatment, then there is nothing on him if he makes a mistake, such as: a scholar if he makes a mistake, he has two rewards if he is right, and he has a reward if he makes a mistake. The reward for diligence.
But if he is not, he does not have complete cleverness in him, but attacks him without care; He is a guarantor and a sinner. But if he is not, he is one of the people who treat this disease, but it is estimated that he made a mistake in treating it, with diligence and investigation, and that he is one of the people who treat this disease, then there is nothing wrong with him, God willing. Because the Messenger said: He who seeks medicine and is not well-known in medicine... But if he is known by him and his family, then he does not have to do anything after making the effort, such as: the scholar who gave his best in issuing fatwas, but he made a mistake.....ماهو حكم الأخطاء الطبية الغير متعمدة.... الشيخ محمد بن صالح العثيمين رحمه الله....سأل الشيخ إبن باز رحمه اللههذا فيه تفصيلٌ:
إذا كان طبيبًا حاذقًا قد اعتنى بهذا المرض، وهو من أهله، من العلاج، قد حذق فيه، وتعلم فيه، ويُعدّ من أهل العلاج، فلا شيء عليه إذا أخطأ، مثل: العالم إذا أخطأ، له أجران إن أصاب، وله أجرٌ إن أخطأ، أجر الاجتهاد.
أما إذا كان لا، ما عنده فيه الحذق الكامل، ولكن تهجم عليه من غير عنايةٍ؛ فهو ضامن وآثمٌ. أما إذا كان لا، هو من أهل العلاج لهذا المرض، ولكن قُدر أنه أخطأ في علاجه، مع الاجتهاد والتَّحري، وكونه من أهل العلاج، ومن أهل هذا المرض، فلا حرج عليه إن شاء الله؛ لأنَّ الرسول قال: مَن تَطَبَّب ولم يكن بالطبِّ معروفًا...، أما إذا كان معروفًا به ومن أهله فلا شيء عليه بعد بذل الوسع، مثل: العالم الذي بذل وسعه في الإفتاء ولكنه أخطأ.....
