In that landmark judgment, the Court ruled that the LG cannot act independently but must work Delhi government vs LG: in harmony with the NCT government, relying on the aid and advice of the Council of Ministers. The three-judge bench, responding to the Centre's request, subsequently referred the issue to the Constitution Bench. The Centre's argument was primarily based on the contention that the majority judgment of the Constitution Bench did not adequately consider the purpose and intent of the expression "insofar as any such matter is applicable to Union Territories" in Article 239AA(3) of the Constitution, which holds pivotal significance.
