Appellate attorneys Tim Kowal and Jeff Lewis discuss an evidentiary faux pas in Epstein v. Prescott Neighborhood Partners, LLC (D1d1 May 13, 2021) no. A159185 (non-pub.).
The trial court also refused to admit the plaintiff's evidence in opposition to the defendant's anti-SLAPP motion. But the plaintiff failed to challenge the trial court's adverse evidentiary rulings. Instead, the plaintiff just proceeded on appeal to rely on that evidence as if it had been admitted. That doesn’t work, the court held. Jeff and Tim then discuss the practical effect is probably negligible, except that it leaves the trial attorney in a bad light.
