The Scheduled Castes and Scheduled
Tribes (Prevention of Atrocities) Act, 1989 requires that alleged acts of intentional insult or intimidation causing humiliation be committed in public view to constitute an offense. According to the Allahabad High Court, a public view is mandatory for an offense to be made out under Section 3(1) (r) of the SC/ST Act !
This means that the incident must occur in a place where it can be observed by members of the general public, and there must be witnesses present. The courts have distinguished between "public place" and "public view," emphasizing that an incident in a public space is insufficient without witnessed observation .
The Raj HC and Bombay High Court have also reiterated this requirement, stating that the alleged act should occur at a place "within public view" .
