Hi, my name is Heather Ford and I am a traffic attorney out in New Orleans. And one thing we'll talk about is one of the things I do sometimes is I will help the client by getting their ticket reduced to non-moving violation, and then put them on a payment plan to be able to pay off their fines and fees for the court, it usually has a payment date. And the question becomes what should you do, if you can't afford to make the payment on the payment date is coming up?

The most important thing you do is you need to let the court know in advance that you will not be able to make their payment. Oftentimes, the court will assign a court date in which the payment is due. So if you pay me paying in full, you don't need to necessarily come to court. But too often, you just make the payment and be done.

But if you can't afford to make the payment, then you need to go in the courtroom and talk to the judge and let them know what's going on that you need more time. Often, the court will work with you and accommodate you. If you are not prepared to make the payment particularly if you’ve been paying regularly. All those things are taken in consideration. But there's nothing worse than just missing your payment without any explanation. Oftentimes, it’s risky, you're opening yourself to be subject to attachment or a bench warrant additional fines like a contempt fine being added in New Orleans they’ll add a contempt fine for some time and also a reinstatement fine.

And so these are just incurring additional costs that they, one cannot afford. And two, they would not have to be added if you just made the request in the first place.
