How are FIRs registered?
1. What is FIR?
FIR is a document on the basis of which the police initiates proceedings to punish the guilty. In case of theft of any goods, FIR is necessary for making an insurance claim. Apart from this, there is a danger of misuse of your thing due to which you get caught in some crime which you did not commit. In such a situation, FIR protects you from any kind of loss.
2. In which cases FIR is registered?
First of all, it is important to know in which case the case is registered. There are two types of offences, non-cognizable and cognizable offences. Non-cognizable offences- Non-cognizable offenses are minor offences, for example, cases of minor assault etc. are non-cognizable offences. In such a case FIR cannot be registered directly, rather the complaint is referred to the Magistrate and the Magistrate can issue summons to the accused in the matter. Then the affair begins. That is, in such a case whether there is jurisdiction or not, the case cannot be registered under any circumstances. Cognizable Offenses – The second case is of cognizable offences, which are serious crimes. In such cases, there are shootings, murder and rape etc., in which FIR is registered directly. Under Section 154 of the CrPC, the police are required to directly register an FIR in a cognizable case.
3. What is Zero FIR?
Even if the crime committed against the complainant has not happened in the jurisdiction of the police station where the complainant reaches with the complaint, the police will have to register a case on the basis of the complaint of the complainant. In such a situation, the complaint is later transferred to the concerned police station. This type of FIR is called ZERO FIR. When any person reaches any police station with a complaint, the first duty of the police is to register the case. If the case is related to a cognizable offence, then even if the offense is committed in any part of the country, the case can be registered in any other part of the country. There is no delay in reporting the crime to the police, so it is important that the complaint is registered. Former High Court Justice R. s. According to Sodhi, the Supreme Court had said in its judgment that irrespective of the locality where the crime took place, the police cannot refuse to register an FIR on the basis of jurisdiction. The police cannot be complacent in any way after registering the FIR. The purpose behind this is to collect the evidence by registering the complaint of the complainant. If the complaint is not registered, the investigation will not happen and the evidence will go on getting destroyed but once the FIR is lodged, the role of the complainant ends and it becomes a state case and then the police have to investigate. In this context, the provision of zero FIR is very effective.
