Forms of Compensation Cheat Sheet
TEMPORARY TOTAL DISABILITY COMPENSATION (TTD)
-Taken off work completely by a BWC doctor in a Medco14 or
-Return to work with restrictions and employer has not made a light duty written job offer
-Can continue to receive TTD comp until you return back to work or are found to have reached “maximum medical improvement” ( MMI )
-If TTD comp has been terminated, you may be entitled to temporary total disability if there are “new and changed circumstances”
-For first 12 weeks paid at 72% of your FWW and then 66 2/3 % of the your AWW
PERCENTAGE PERMANENT PARTIAL DISABILITY AWARD (PPD or C92)
-Can apply for a C92 award 26 weeks after the date of injury or 26 weeks after the last receipt of compensation whichever is later
-Are assessed by a medical professional in a C92 examination and are assigned a percentage based on the partial impairment due to your work injury
-Receive 2 weeks of compensation for every percentage
-The award is capped at the maximum PPD rate for the year of the injury
-PPD Award is not a settlement of your workers comp claim
-Can file for an increase in PPD award if conditions have gotten worse
WORKING WAGE LOSS
-Can apply if you are suffering a wage loss due to your work injury
-Need work restrictions from your BWC doctor
-Must be suffering a wage loss due to either being paid less or working less hours due to the work restrictions in your allowed claim
-Paid at 66 2/3 of the difference between your present income and AWW
-Can receive a maximum of 200 weeks of working wage loss
-Must register with the Ohio Department of Job and Family Services
-Must submit weekly job search forms for each week of working wage loss
NON-WORKING WAGE LOSS
-No longer qualify for temporary total disability compensation due to a finding of MMI
-Need work restrictions from your BWC doctor
-Must register with the Ohio Department of Jobs and Family Services
-Must submit job searches each week of non-working wage loss
-Paid at a rate 66 2/3 of your AWW
-Can receive a maximum of 52 weeks
-Caveat, in total you can receive 226 of working and non-working wage loss, 200 weeks of working wage loss and 26 weeks of non-working wage loss
LIVING MAINTENANCE
-Compensation received when you participate in a vocational rehabilitation plan
-Paid at 66 2/3 of your AWW, but no less than 50% of the State Wide Average Weekly Wage
-Unlike other forms of comp it is taxed
LOSS OF USE AWARD ( Scheduled Loss Award )
-Compensation you receive when a limb is amputated, or the limb is still present but for all intents and purposes it is non-functional
-Each body part is paid has a certain number of weeks which is payable per statute
-For each week of the scheduled loss you receive 100% of the Statewide Average Weekly Wage for the year of injury
FACIAL DISFIGUREMENT AWARD
-Available if you receive a facial disfigurement which impairs or may impair your future ability to secure or retain employment
-May be awarded up to $10,000
VSSR AWARD ( Violation of a Specific Safety Requirement )
-The IC determines if the employer violated a spefic safety requirement and assigns a percentage between 15 % and 50%
-For all past and future weeks of compensation, a vssr award will be paid at the penalty percentage at the Maximum Comp Rate for the year of Injury
-This award of compensation is paid in addition to normal compensation you have received
PERMANENT TOTAL DISABILITY
-Can receive if you are unable to return to gainful remunerative employment, caveat cannot return to any work under PTD
-Can receive statutory permanent disability if you have lost the use of two or more limbs, can return to work under statutory PTD
-Paid at 66 2/3 % of your average weekly wage, can supplement your PTD payments with DWRF payments (make up for inflation)
-May take out lump sum loans from future payment of PTD for things like funerals, or purchasing a car/house or other things essential for living
