The five-judge bench ruled on a batch of petitions related to the split in the Shiv Sena, disqualification of MLAs and the role of the governor in the case. The Sc ruled that the Governor should not have called for trust vote as he didn’t have material before him indicating that the Uddhav govt had lost trust. However, he said the governor was right in inviting Eknath Shinde to form govt after Uddhav quit without facing trust vote. The bench also ruled that the order by the deputy Speaker appointing an MLA of the Eknath Shinde faction as Sena whip was illegal. The SC said that the Uddhav govt can’t be restored as the CM had resigned voluntarily.
