This video adds another defense to our growing list of defenses to contract formation. The claim that the subject matter or terms of a contract violate the law or run afoul of established public policy can sometimes serve as a defense. We'll see that there are some clear cut cases but also doubtful ones where we need to balance the policies for and against enforcing the contract.
