Georgia law states that after you are arrested for DUI, the law enforcement officer must read you the proper Georgia Implied Consent Notice asking you if you want to take a blood, breath, or urine test.
After reading from the implied consent notice the officer can petition to suspend your drivers license if the test provided comes back at over .08 for alcohol or positive for drugs. The officer can also petition to suspend your license if you refuse to take the state administered test(s) of the officer's choosing.
If the officer petitions to suspend your drivers license, he is supposed to present you with a dds-1205 form which acts as your temporary drivers license. It is also a notice of suspension telling you if you do nothing, your license will be suspended in thirty days. Finally, it acts as a notice of appeal procedures to appeal the petition to suspend your driver's license. You have ten business days from the date you are arrested to appeal the pending drivers license suspension.
If your drivers license is suspended it could be a hard one year license suspension without the ability to acquire a limited driving permit to drive to work.
Call our office immediately at 404-581-0999 if you've been arrested for DUI and have questions about the status of your drivers license. We are here to help you understand all the potential outcomes and help you prevent a one year suspension of your drivers license.
