"WHAT IS AN APPEAL TO THE SEND TRIBUNAL?"
If the LA refuses an EHC needs assessment, refuses to make an EHC Plan after an assessment, or issues a final EHC Plan whose provision or placement are disputed, a child’s parents or a Young Person can appeal against their decision to the ‘Special Educational Needs and Disability Tribunal’, known as the ‘SEND Tribunal’.
The SEND Tribunal is an independent body not influenced by LAs or parents set up to be as accessible as possible and is a ‘specialist’ Tribunal panel with a legally qualified chairperson, known as a ‘Tribunal Judge’, and one or two ‘specialist’ wing members, with experience of SEN.
Parents or the Young Person have 2 months from the decision to appeal against it, but only where they first obtain a ‘Certificate of Mediation’, which they must do within the 2 months or within 30 days or 1 month from the Certificate, whichever is later.
