Section 230 of the CDA was passed as part of the huge overall of the communications act of 1996. It single handedly allowed the Internet to become what it is today. Early in the Internet history there was Compuserve and Prodigy. One chose to hire a team of moderators to filter their content, the other chose to do nothing. Both got sued for their approach. Soon after these cases arose congress wanted to stimulate and encourage Internet growth. They created the protections in the CDA section 230 that basically says: No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.

By doing this it made sure that Internet providers and Internet services were not responsible for what third parties posted to their services. This means they could not be sued for what someone else did on their systems. Fast forward and hate speach, human and sex trafficing took to the Internet and these things had to be addressed. Today companies like Facebook, Youtube and Twitter are now policing their content, effectively putting their protections outlined in the Communications Decency Act under scrutiny. Both parties want to amend these rules in different ways and protect freedom of speech. We are in for a number of tough years as they hash this out. Hopefully we don’t forget why the legislation happened in the first place.
