Описание: Relief for Emerald Court Residents, Twin towers to be demolished within 2 months
It was a huge relief for the residents of Emerald Court in Noida Sector 93A. In a big blow to the realty company, Supertech Limited, the Supreme Court on August 31 directed demolition of twin 40-storey towers. From this video anyone could guess the blatant way the realty firm flouted norms by launching the two 40-story towers in the premises of the Emerald Court. The names of these twin towers are Apex and Ceyane. These two towers are proposed to have together 915 apartments and 21 shops. Of these, 633 flats were booked initially. The builder had said that out of 633 people booking the flats initially, 133 have moved out to other projects, 248 have taken refunds and 252 home buyers still had their bookings with the company in the project.
SC said the complicity of authority officials is revealed from the sanctioning of second revised plan of the project on November 26, 2009. It was a clear breach of building regulations. Authority also refused to disclose the plan to the Resident Welfare Association. In fact, authority wrote to Supertech seeking permission to share the sanctioned plan with RWA. Upon refusal by the builder, the corrupt officials declined to share the plan.
Chronicle of the Emerald Court Case:
June 2005: Plan sought to build twin towers each with nine floors and softs in total.
December 2006: Plan modified to 15 towers with 11 floors each and 689 total flats.
November 2009: Plan revised again to include two more towers - Apex and Ceyane - with 24 floors. Construction begins
March 2012: No of floors gone up to 40 in the two towers.
December 2012: Emerald Court Owners RWA approached Allahabad HC claiming the towers violated UP Apartment Owners Act, 2010 that required sanction of homebuyers for changes in plan. Towers came up over an area marked as a garden in brochure, RWA argued. SC was briefed the towers were built at less than the mandated 16 metre distance between them.
April 2014: HC ordered demolition of the towers and refund to buyers with 14 per cent interest. It observed that officials of Noida Authority colluded with the builder to construct the towers; towers sealed
May 2014: Noida Authority and Supertech move Supreme Court claiming no norm was flouted. Homebuyers too move court seeking refund, regularisation of towers or order to shift them to another project
August 2021: Supreme Court slams Noida Authority for its "shocking" misuse of powers to sanction the two towers, upholds high court's demotion order

Demolition should be done in three months, paid for by Supertech
Homebuyers in the two towers to get refund at 12 per cent interest in two months
Rs 2 crore to be paid to RWA within a month as compensation
Men behind this battle
Senior citizens, including a retired DIG of the CISF, a former DRDO official and a deputy director general in Telecom Department, started the court battle.
