By Appellant’s Notice filed on 11 February 2025 the Appellants appeal the decision of the High Court, judgment being delivered on 25 September 2024 following trial.
The Appellants are former Northern Rock mortgage borrowers whose loans were transferred to TSB in July 2016 and are now managed under the “Whistletree” brand.
Each Appellant had a mortgage with an initial fixed-rate period, reverting to a Standard Variable Rate (SVR). After Northern Rock’s collapse and nationalisation in 2008, they expected to remortgage at similar fixed rates but were unable to do so due to post-crisis FCA affordability rules.
TSB initially maintained the previous rate but later introduced a “Whistletree SVR,” which it varied under Condition 7.2 of the General Conditions applicable to the mortgages. The Appellants argue that charging the Whistletree SVR breached the contract, as TSB should have either kept the original rate or applied its own SVR.
