📌 Your landlord has just handed you a rent increase notice you think is completely unfair. Here is what most renters do not know — you can challenge it at a free independent tribunal, and the statistics show you are more likely to WIN than to lose.
Tenants who challenge unfair rent increases at the First-tier Tribunal win 71% of cases and save an average of £1,140 per year. And under the Renters' Rights Act 2025, the tribunal CANNOT set your rent higher than what your landlord proposed — so there is zero financial risk in challenging.
Watch this video in full and you will know exactly how to use this free legal process to fight back against any unfair rent increase.
⚠️ THE MOST IMPORTANT CHANGE UNDER THE RENTERS' RIGHTS ACT 2025:
Before May 2026, some tenants avoided the tribunal because there was a small risk the rent could come back HIGHER. That risk is now completely gone. Under the Renters' Rights Act 2025, the tribunal can ONLY confirm or LOWER your landlord's proposed figure. It cannot set it higher. Ever. This means challenging your rent increase now carries ZERO financial risk.
📋 WHAT YOUR LANDLORD MUST DO CORRECTLY BEFORE ANY RENT INCREASE IS VALID:
✅ Must use the official Form 4A (the old Form 4 is INVALID from 1st May 2026)
✅ Must give at least 2 months written notice before the new rent starts
✅ Can only propose a rent increase ONCE in any 12-month period
✅ New rent must start at the beginning of a new rental period (e.g. 1st of the month)
If your landlord got ANY of these wrong — the notice may already be INVALID. You can challenge the validity separately using the MR1 form before even getting to the rent amount.
🏛️ HOW TO CHALLENGE YOUR RENT INCREASE — STEP BY STEP:
1️⃣ Check your Form 4A for technical errors (wrong form, wrong dates, insufficient notice)
2️⃣ If the notice has errors — submit MR1 form to challenge validity BEFORE the effective date
3️⃣ If the amount is above market rate — submit RENTS1 form via GOV.UK BEFORE the effective date
4️⃣ Write to your landlord simultaneously with comparable evidence and a counter-proposal
5️⃣ Build your evidence bundle (Rightmove/Zoopla comparables, property photos, repair history, EPC)
6️⃣ Keep paying your CURRENT rent throughout — do NOT pay the new proposed amount
7️⃣ Submit your evidence bundle to the tribunal and respond to any requests promptly
⚠️ THE DEADLINE IS CRITICAL: You MUST submit your RENTS1 application BEFORE the effective date stated on your landlord's Form 4A notice. Miss it and the new rent takes effect automatically — forever.
💰 WHAT HAPPENS WHILE YOU WAIT:
Once you submit your RENTS1 application, the proposed new rent is SUSPENDED. You keep paying your current lower rent until the tribunal decides. The process typically takes 6—12 weeks. The longer it takes, the more months you save at your current rent.
📂 WHAT EVIDENCE WINS AT TRIBUNAL:
→ Comparable rental agreements for similar nearby properties (strongest evidence)
→ Rightmove and Zoopla listings for similar properties nearby (accepted by tribunal)
→ Photographs of any disrepair or outstanding maintenance issues
→ EPC energy performance rating of your property
→ Correspondence with landlord about repairs
→ Original tenancy agreement showing property features
→ Your full rent payment history showing reliable payment
⚠️ CRITICAL WARNINGS:
❌ Do NOT withhold rent while waiting — this creates arrears and risks Section 8 eviction
❌ Do NOT pay the new proposed amount while waiting — this can be taken as acceptance
❌ Do NOT withdraw your RENTS1 application until any written agreement with landlord is signed
