The principle of burden of proof is based on the concept of the onus probandi & factum probands. As per the law, if a party asserts a claim then they are required to back it with sufficient evidence in a court of law. Determining what constitutes sufficient evidence varies from case to case. Presumptions are the inferences drawn by the courts in favor of a party that does not have the burden to prove the assertions. In this webinar, the speaker carries a detailed explanation of the concept of burden of proof and how presumptions shift from one party to the other as the case progresses and shares real cases to get a better understanding of the principles.
