Redner v. Sanders | 2000 WL 1161080 (2000)

Jurisdiction based on diversity of citizenship allows federal courts to hear disputes between United States citizens residing in different states, or between United States citizens residing in one state, and citizens or subjects of other nations. But may American citizens residing abroad sue other United States citizens in federal courts? The United States District Court for the Southern District of New York considered that question in the 2000 case of Redner versus Sanders.

Stephen Redner, an American citizen living in France, filed a lawsuit in the United States District Court for the Southern District of New York against New York resident Steven Sanders and a New York-based corporation. Redner asserted that the court had diversity jurisdiction because he lived in France and the defendants were all New York residents. Redner further claimed he had contacts with California, including a driver’s license, a license to practice law, and an office he visited about four times a year.

Sanders and the remaining defendants moved to dismiss Redner’s complaint for lack of diversity jurisdiction. The district court then reviewed Sanders' complaint and the defendants' motion.
