Описание: There is one old immigration law that can still override illegal entry and visa overstays. It’s called Section 245(i), and it allows certain people to apply for a green card inside the United States even if they would normally be barred. If a qualifying family-based or employment-based petition was filed for you years ago, even decades ago, that filing alone may still protect you today. The case does not need to be approved. It does not need to still be active. And it does not have to be the case you’re using now. What matters is whether the case was approvable when filed and whether you meet the timing and physical-presence rules. I’ve seen old petitions from the 1990s and early 2000s completely change someone’s immigration options today. Never assume you don’t qualify. This is one of the most misunderstood and overlooked areas of immigration law. 📍 Brad Bernstein, Esq.
