Grolemund v. Cafferata, 111 P.2d 641 (1941)

In California, property held by spouses can be classified as either separate property, meaning it belongs to one spouse, or community property, meaning it belongs to both spouses with each having a one-half ownership interest. In Grolemund versus Cafferata, we explore the intersection of that distinction and tort liability.

Husband and wife Caesaer and Lena Grolemund purchased a lease interest in a San Francisco boarding house and also purchased the building’s furniture. They made the purchase using funds that consisted of Caesaer’s earnings commingled with Lena’s separate money. A few years later, again with commingled funds, the spouses purchased real property in San Mateo County.

In 1933, Caesaer was involved in a car accident. The injured parties, including Emilio Cafferata, sued Caesaer for negligence and secured a judgment against him for damages. Sheriffs in San Francisco and San Mateo County seized the Grolemunds’ property in their respective locales, intending to sell the property at sheriffs’ sales so that the proceeds could be used to satisfy the judgment.

In response, the Grolemunds filed suit against Cafferata and the sheriffs, seeking a permanent injunction preventing them from proceeding with the sales. The Grolemunds argued that the seized property was community property and that as such, it couldn’t be used to satisfy the tort judgment, which was against Caesaer alone.

The trial court agreed that the property was community property but held that Cafferata and the sheriffs were nevertheless entitled to proceed with the property sales to satisfy the judgment against Caesaer. Lena appealed to the California Supreme Court.
