The defense makes a settlement offer. It's a large offer. You are seriously considering whether to accept the offer. But you think you can get more.

Is it time to gamble and throw the dice hoping for more?

Or is there a chance that you'll be thrown out of court without getting a dime in compensation if you do take that chance of getting a jury verdict?

As I was preparing to leave Las Vegas after lecturing to lawyers, I thought I would give you a quick look at the risks and benefits of going to verdict in light of a significant settlement offer.

Any time you go to a jury and take a verdict, you are gambling. It may not be like playing blackjack or craps or even roulette, but it is a gamble nevertheless.

If the defense refuses to offer any money, then it's obvious that you are going to take a jury verdict. If on the other hand the defense wants to try and settle and offers a substantial amount of money, you then must carefully consider whether the settlement offer is appropriate or whether you are going to take a gamble and risk getting more with a jury, getting a similar result or less, or nothing.
