JUDGMENT
Juvenile-X’s counsel argued that they were innocent and falsely implicated.
The defense pointed out that Juvenile-X was declared a juvenile by the Juvenile Justice Board based on educational certificates.
Interestingly, Juvenile-X was not initially named in the First Information Report (F.I.R.), and their name surfaced later due to the confessional statement of Amit Kumar.
The alleged motorcycle involved in the incident had not been seized during the investigation.
Court’s View:
The Allahabad High Court weighed the evidence and considered Juvenile-X’s age.
In a related case (referred to as Sanjay Kumar’s case), the court held that every juvenile, regardless of the offense, should be released on bail. However, bail could be refused if there were reasonable grounds
