What's the difference between a deposition, mediation, and trial?
A deposition is a proceeding where you answer questions under oath. Depositions usually take place in a conference room, not the courtroom. But, deposition testimony has the same weight and importance as trial testimony. Because of this, it is extremely important for parties to spend significant time with their attorney in preparing for deposition. Depositions also give opposing counsel the opportunity to size you up and make a determination about whether a jury will like you. Therefore, your body language and attitude are almost as important as the actual testimony.
Mediation is a confidential proceeding designed to work toward resolution. While mediation is not yet mandated in every case, most courts require the parties to mediate before going to trial. At mediation, a mediator with no affiliation to either party
