Forget selling, the builder or promoter cannot ‘legally’ even market, advertise or promote his or her real estate project without RERA registration! [As per section 3(1)]🚫
So make sure that as a customer, you ask the builder for the RERA number of the building or project he or she is selling! With this RERA number you can also verify and cross check and scrutinize various legal documents submitted by the builder to the RERA authority. 🔎
This of-course applies for projects that are required to get registered under RERA. However, certain kind of developments don’t need RERA registration such as:
i) where area of land proposed to be developed does not exceed 500 sq meters.
ii) where number of apartments does not exceed 8 (inclusive of all phases)
iii) where the project has already received its Occupancy Certificate before the commencement of this Act. (ie 2017 in most States)
iv) where it is a redevelopment project or renovation of a building where no marketing or no new sale or allotment is involved!
