A Bench Trial is a trial conducted by a judge. Everyone knows what a Jury Trial is, and we see that all the time: where you have a jury sitting in a jury box hearing a case and deciding what happened. A Bench Trial is a case where you do not have a jury deciding whether you’re guilty or not guilty, you have a judge that sits there and hears the case. All summary court cases - all Magistrate court cases - in our jurisdiction start out as Bench Trials. It’s very similar to if you get a speeding ticket and you have a court date, and many people have gone and stood in front of the judge and told the judge what happened and then the judge decides whether the person is guilty or not guilty. That’s what a Bench Trial is.
Now, you also could have a Bench Trial in the Circuit Court, in the felony court, but it almost never happens because it’s so much better to trust your fate to a jury of your peers rather than have the court system decide if you’re guilty and what should happen to you.
