In a significant judgment, the Supreme Court has recognised homemakers as “nation builders” and held that the loss of domestic care provided by a homemaker constitutes a distinct and compensable head of damages in motor accident claims.
A Bench of Justices Sanjay Karol and AG Masih fixed a minimum value of ₹30,000 per month for domestic care services while determining compensation. The Court observed that homemakers play a vital role in families, society and the development of human capital, making their contribution indispensable and deserving of legal recognition.
The judgment also noted that it is ironic to label homemakers as dependants when households function substantially because of their unpaid labour and caregiving work.
Key Takeaways:
• Supreme Court calls homemakers “nation builders”
• Loss of domestic care recognised as separate compensable damage
• Minimum value fixed at ₹30,000 per month
• Homemakers' contribution extends beyond households to society
• Important precedent for motor accident compensation claims
