In this important judgment, the Lahore High Court Rawalpindi Bench examined whether a Constitutional Petition under Article 199 of the Constitution of Pakistan can be converted into a Review Petition when an effective alternate remedy exists under the Punjab Board of Revenue Act, 1957.
Justice Mirza Waqas Rauf held that courts possess inherent powers to convert proceedings in the interest of justice. Relying on Supreme Court precedents including 2017 SCMR 118, 2016 SCMR 834, and 2023 SCMR 1451, the Court ruled that litigants should not suffer due to technical mistakes or wrong forum selection.
This case arose from a land demarcation dispute under the Punjab Land Revenue Act, 1967, and clarifies the doctrine of Conversion of Proceedings, Ex Debito Justitiae, and the principle that an act of court shall prejudice no one.
