Описание: The Supreme Court has declined to reconsider its May 2025 ruling that made prior legal practice mandatory for entry into the judicial service. However, it has modified the requirement by reducing the mandatory practice period from three years to one year.

Under the revised framework, candidates selected for judicial service will have to undergo one year of training at a Judicial Academy, followed by one year of structured clerkship under the supervision of judges.

For candidates falling within the transition period from May 20, 2025, to March 31, 2027, the Court has waived the practice requirement. Law graduates during this period can appear for the Civil Judge (Junior Division) examinations without prior legal practice. However, those selected will be appointed as trainee judicial officers for one year, followed by another one-year structured clerkship.

The Court observed that abruptly restoring the three-year practice requirement without providing any transitional arrangement had caused considerable hardship to young lawyers and fresh law graduates. It therefore held that a limited modification of the earlier judgment was necessary.

For examinations notified on or after April 1, 2027, candidates will be required to have one year of legal practice. After selection, they will additionally undergo one year of judicial training and one year of clerkship.

The verdict was delivered by a bench comprising Chief Justice of India Surya Kant, Justice August George Masih, and Justice K. Vinod Chandran, who dissented. The bench was hearing review petitions challenging its earlier decision that had made three years of legal practice compulsory for candidates seeking direct recruitment as Civil Judges (Junior Division).
