Respondent’s Position: The Association argued it was not responsible for the original construction defect caused by the builder. It asserted it met its obligations by repairing the line once the defect was verified and that its response timeline was reasonable.

Hearing Findings and Analysis
Administrative Law Judge Daniel G. Martin ruled that the Petitioner bore the burden of proving a violation of the Declaration. The ALJ made the following determinations:
Maintenance: There was no evidence that the Association failed to maintain the "Y" connection or that the backflows resulted from a lack of routine maintenance.
Repair and Timeliness: The ALJ analyzed the delay between the initial notice (July 13, 2004) and the repair (October 22, 2004). The judge found this three-month period was not unreasonable given that the cause of the blockage was initially unknown, the parties were engaged in legal negotiations, and the Board was in recess for part of the summer,. The Board acted reasonably by authorizing an investigation and subsequently paying for the repair,.
Damages: Because the Petitioner failed to demonstrate a violation of the Declaration, there were no grounds to award damages. The ALJ noted that even if liability were established, administrative jurisdiction is generally limited to remedial restitution rather than full compensatory damages.

Final Decision
The ALJ concluded that McBee failed to prove the Association violated Section 6.3 of the Declaration. The petition was denied, and McBee was not considered the prevailing party.
