How is it that some cases are decided by only a judge and other cases are decided by a jury of your peers?
Did you know that when you bring a lawsuit seeking compensation for the harms and losses you suffered as a result of a doctor's carelessness you have the ability to decide whether you want to have your matter decided by a jury of your peers or only by a trial judge.
That's known as either a non-jury trial or a jury trial.
There are pros and cons to each selection.
In a non-jury trial that is tried with only one judge, he will then act (1) as the fact-finder, (2) make rulings of law and (3) determine whether you have proven your case-in other words that you have shown that you are more likely right that wrong.
In addition, if the judge determines that the doctor or hospital departed from good and accepted medical care and that carelessness was a substantial factor in causing or bringing about your injuries, then the judge will have to (4) determine how much compensation to provide to you.
On the other hand, in a jury trial you will have six members of the community listening and evaluating your case.
Likewise, they will also have to determine whether you have shown that you are more likely right that wrong.
If the jury finds that the doctor or hospital violated the basic standards of medical care, and if those departures were substantial factors in causing and bringing about your injury, they will then determine how much money to put in their verdict in your behalf.
