The matter of electoral manifesto has reached the courts on several occasions challenging either its legality or non-fulfilment of the promises enlisted therein. To examine the legality of such manifesto it is important to consider Section 123 of the Representation of the People Act, 1951 (‘RP Act’), which elaborates all acts amounting to “corrupt practices”. It includes “bribery”, which refers to any gift, offer or promise by a candidate or his agent or by any other person with the consent of a candidate or his election agent of any gratification, directly or indirectly inducing an elector to vote or refrain from voting on a certain manner. Similarly, it also includes “undue influence” which is any direct or indirect interference or attempt to interfere with the free exercise of any electoral right. However, a declaration of public policy, or a promise of public action, shall not be deemed to be “interference” within the ambit of this clause.
