You can get bail even though there is no FIR registered against you. Section 438 of Crpc defines the grant of Anticipatory bail to person apprehending his/her arrest.
In the revolutionary judgement laid down by the Supreme court of India in Shushila Aggarwal and others vs State (NCT of Delhi) and Anr the five judge bench of Supreme Court decided that a person apprehending arrest can be granted a anticipatory bail even though no registration of FIR has taken place against him/her.
On the ground that he apprehends arrest in case under preliminary investigation.
