The Transgender Persons (Protection of Rights) Amendment Bill, 2026, introduced in the Lok Sabha on Friday by Social Justice Minister Virendra Kumar, proposes to narrow the definition of 'transgender person' to those with specific socio-cultural identities or medically recognised intersex variations — excluding self-perceived gender identity entirely. The Bill deletes Section 4(2) of the 2019 Act, which guaranteed the right to self-identification, and introduces a medical board as a mandatory step in obtaining identity certificates. It also creates new graded penalties — ranging from six months to life imprisonment — for abduction, bodily harm, and forced identity assumption, while retaining the existing two-year cap for physical and sexual abuse of transgender persons.
