In this video, Attorney Kevin Seaver discusses when and why the Massachusetts Department of Children and Families (DCF) interviews children alone at school and why this practice raises serious concerns. While DCF has the authority to speak with children privately during investigations, Attorney Seaver explains how these interviews can be emotionally harmful and often occur without parental consent or oversight. He also shares a real case example that shows how damaging these interviews can be, and why every parent should protect their child’s rights by sending a Hatch Letter to their school.
You’ll also learn:
Why DCF interviews children alone in certain investigations
How private school interviews can emotionally affect children
What rights parents have when DCF wants to speak to their child
How a Hatch Letter can help prevent unauthorized interviews
Why children deserve protection, privacy, and respect during DCF investigations

The Law Office of Kevin Patrick Seaver successfully represents anyone involved with the Massachusetts Department of Children and Families (DCF).
We will represent you and your children anywhere in the state of Massachusetts in cases involving DCF. This includes both in court and out of court representation.
I will prepare you and your children before the DCF home visit. The DCF home visit may include an interview, investigation, or assessment of you and your children. I will be physically present during the DCF visit. I will also be physically present when DCF meets with both you and your children.
One of the biggest mistakes I have seen throughout the years are parents/caretakers trying to represent themselves in fighting DCF.
DO NOT DO IT ALONE.
You and your children should always be represented by a lawyer when speaking to DCF.

Transcript:
Can DCF interview your children alone at school in Massachusetts? DCF can and will interview your children alone in Massachusetts. It's not the best process or procedure or protocol, but in certain circumstances, DCF feels compelled to do that. At least that's what they tell me when I ask them, why do you interview the child alone? They tell me that, well, they couldn't interview them at home because there's domestic violence. I don't know where that comes into play, but DCF will tell you that. They'll also tell you where there's Suspicion of a child being at substantial risk of harm. And that there was nowhere else they could interview them where they felt they could interview them properly. That's just garbage. That's just DCF's way of saying that. They want to avoid attorney-saver or the parents of both. Because think about this. If DCF's on the up-and-up and you want to interview children, they want us to record it so that everybody can hear the recording. And why don't they record it? They don't want you to hear them asking your child 20 times about, you know, how often does your father beat up the mother? We know the father beats up the mother. Then you say, well, how do I know those types of questions to ask? I recently had a family where they had a 15-year-old daughter. She was all everything, all honor rolls, all athletic, all this, all that. She was on the student council. She ran for this, ran for that. She did everything at the school. And she loved the school, absolutely loved the school. And she received all types of awards and all types of prestigious things. And her mother and father had a disagreement one night. And DCF went to the school and interviewed this girl for well over an hour. Now, I don't know what you're going to interview anybody about for over 10 or 15 minutes when it comes to child abuse and neglect, but that's just me.
