Liability is a common term in home insurance.

The definition of liability is the legal responsibility for one’s actions. Liability insurance offers coverage for damages when someone is found liable for unintentionally injuring a third party, or damaging their property.

Liability insurance only applies in cases of negligence, meaning that liability coverage doesn’t apply in cases where the injury or damage was intentional.

We also differentiate personal liability from premises liability. Personal liability involves a person’s direct actions, regardless of where the incident happens. Premises liability deals with situations where a person’s homeownership leads to injury or damage.

As an example of premises liability, we look at the case of a homeowner failing to clear their front step of ice. A delivery person slips, falls, and injures themselves. Since the homeowner has a legal responsibility to keep their premises safe for visitors, the homeowner can be found liable in this example, even though they didn’t directly injure the delivery person.
