This lecture, part of Professor Stevenson's Law and Economics Seminar at South Texas College of Law Houston, provides a rigorous economic analysis of democratic institutions and voting rights.
We examine the inherent tension between democratic participation and economic efficiency, exploring how constitutional democracies utilize structural restraints and the Bill of Rights to prevent negative externalities—specifically the exploitation of minority groups by a temporary majority.
The core of the lecture applies Public Choice Theory to the "Franchise." We analyze the strategic motivations behind the expansion of voting rights, including the little-known historical alliance between the Suffrage and Prohibition movements. Additionally, we discuss the informational value of elections in revealing citizen preferences and the economic theory of voter dilution as a mechanism for institutional stability and a safeguard against factional capture.
