40 साल तक एक परिवार दरगाह की सेवा करता रहा। बिजली का कनेक्शन उनके नाम पर था, सरकारी विभागों की अनुमति भी उनके पास थी। लेकिन अचानक वक्फ बोर्ड ने दावा किया कि यह दरगाह वक्फ संपत्ति है और किसी दूसरे व्यक्ति को उसका मुतवल्ली नियुक्त कर दिया।
इस महत्वपूर्ण फैसले में मद्रास हाई कोर्ट ने स्पष्ट किया कि हर दरगाह, हर कब्र या हर मुस्लिम धार्मिक स्थल अपने आप वक्फ संपत्ति नहीं बन जाता। वक्फ घोषित करने के लिए वक्फ एक्ट की धारा 4 और 5 के तहत विधिवत सर्वे और गजट नोटिफिकेशन अनिवार्य है।
Can a property become Waqf merely because it has been used for religious purposes?
For nearly 40 years, a family managed and maintained a Dargah. The electricity connection was in their name, and they held permissions from various government departments. However, the Waqf Board later claimed that the Dargah was Waqf property and appointed another person as its Mutawalli (manager).
In this significant judgment, the Madras High Court clarified that not every Dargah, grave, or Muslim religious place automatically becomes Waqf property. The Court held that a property can be treated as Waqf only after following the mandatory procedure prescribed under Sections 4 and 5 of the Waqf Act, including a proper survey and Gazette notification.
This ruling draws an important legal distinction between religious use of a property and its legal status as Waqf, reinforcing that statutory requirements cannot be bypassed.
