In this case, the issue is whether an Age Discrimination in Employment Act (ADEA) claim can be subjected to compulsory arbitration under an arbitration agreement in a securities registration application. The Supreme Court found that agreements to arbitrate statutory claims, such as ADEA claims, are enforceable under the Federal Arbitration Act (FAA) unless Congress intended to preclude a waiver of judicial remedies. It was also recognized that agreeing to arbitrate a statutory claim does not waive the substantive rights provided by the statute.
