North Carolina Landlords need to know North Carolina Landlord laws when managing their rental. These North Carolina Lease laws govern the relationship between Landlords and Tenants and protect both parties if conflicts arise. In this video, we cover everything you need to know about Tenant and Landlord laws in North Carolina, including the North Carolina Security Deposit Receipt and Lead-Based Paint Disclosure.

The Lease Agreement is the foundation of the Landlord-Tenant relationship. It outlines key terms and rules and is what protects both parties if issues arise. A standard, fixed-term Lease is usually for a one-year (12 months) term that ends at the end of the Lease period. Either party can terminate a North Carolina Lease Agreement with 7 days’ notice.

North Carolina Lease Requirements
There are some Lease disclosures that are required by North Carolina Landlord Tenant laws.
If the rental unit was built before 1978, landlords must provide tenants with a lead-based paint disclosure form. This form must inform tenants about the potential dangers of lead-based paint and any known lead-based paint hazards in the rental unit.
If the Landlord collects a security deposit, the Landlord must provide Tenants with a Security Deposit receipt stating the name and address of the financial institution where the security deposit is being held.

Landlord Tenant Laws North Carolina
Now, let’s talk about some key Landlord-Tenant laws in North Carolina.


North Carolina Security Deposit Regulations
For Lease Agreements of more than one month, the security deposit may not exceed two months' rent. For month-to-month Leases, the security deposit may not exceed one and a half months’ rent.

Within 30 days of the Tenant giving up possession of the rental, the Landlord must either return the security deposit or send a notice stating that there is damage and that an additional 30 days are necessary to estimate repairs.

North Carolina Landlord Entry Laws
There are no specific notice requirements for Landlord entry for non-emergency reasons; however, we always recommend that Landlords give at least 24 hours written notice.

North Carolina Late Fee Requirements
Late fees are another important aspect of North Carolina Landlord Tenant lease laws. North Carolina has a 5-day grace period, so late fees cannot be assessed until rent is at least 5 days late. Late fees must be stated in the Lease Agreement and cannot exceed $15 or 5% of the rent amount due, whichever is greater.

Renters Insurance in North Carolina
North Carolina Landlords may require Tenants to get renters insurance and can make failure to do so a breach of the Lease Agreement.

North Carolina Returned Check Fees
Returned payment fees may not exceed $25.

North Carolina Increase in Rent Laws
There are no limits in North Carolina on how much a Landlord may increase rent. However, the rent increase procedure and notice requirements should be stated in the Lease Agreement.

North Carolina Landlord Responsibilities
Landlords must keep rental units in a habitable condition with all essential services working properly. Tenants should promptly notify Landlords of any necessary repairs. Tenants in North Carolina have specific rights, including the right to withhold rent if essential repairs within a reasonable timeframe.

If a Tenant violates the Lease Agreement or fails to pay rent, Landlords may initiate eviction proceedings. Before doing this, it’s vital to provide Tenants with the required Notice.
