The Competition Authority of Kenya's Enforcement & Compliance, Mr. Gideon Mokaya, on September 23 2020, made a presentation on Competition Enforcement in Times of Crisis with a focus on the Authority's interventions during the Covid-19 pandemic.
Mr. Mokaya was speaking during the second of three days of the Annual Capacity Building Workshop. Some of the disruptive effects of the Covid-19 pandemic on markets include: higher prices, product shortages, new entrants, cooperation among competitors.
The Competition Act enables the Authority address market distortions. The Act contains sections dealing with agreements, exclusions, unconscionable conduct, block exemptions, and bid rigging, among others.
During the pandemic, the Authority intervened to remedy market distortions in various ways including issuing cease & desist orders, remedial orders, cautionary notices, advisories, investigations, and stakeholder engagements.
