In Virginia, can you refuse a breath test? It depends. You have an absolute right to refuse the Preliminary Breath Test (PBT) but not the breath test at the police station. This is how you tell the difference between the voluntary breath test and the mandatory breath test:
The Voluntary Breath Test:
1) A PBT
2) Small handheld breath test device
3) given on the side of the road
4) Given before you are arrested for DUI.
The mandatory breath test:
1) Called an ET (EC/IR II)
2) Is large and connected to a printer and keyboard
3) Located at the police station
4) Is given after you are arrested for DUI.
