Missing Mom: Attorney explains how upcoming hearing could send Brad Simpson home

Описание: The defense team of Brad Simpson, the man accused of murdering his wife Suzanne, is requesting an examining trial. According to legal experts, the results of that trial could be enough to send Brad home.

Local attorney Adam LaHood isn't part of the case, but weighed in on the next steps in the legal process.

"It's a hearing that the defense and prosecution have before a judge or a magistrate, and it's there to determine a couple of things," LaHood explained. "One, is there probable cause to continue detaining the person? And, is bail sufficient to detain them if there is probable cause?"

Brad's defense team will face the court soon, where they'll hear what evidence the state has collected so far. And, more importantly, if that evidence is strong enough to continue holding him.

"If they are able to get an examining trial and a magistrate's able to look at the evidence saying, 'Hey! This is pretty weak. You know? There's not enough really here to hold him,' Then it could result in a bond reduction .. or in his immediate release," LaHood said. "Which would, in my estimation, be what they're trying to go for."

Brad is in custody at the Bexar County jail on a $3 million bond. He's accused of murdering his wife Suzanne back in October, along with tampering with evidence and having a prohibited weapon. But, with Suzanne's body still missing, the defense is racing against the clock.

"If the state doesn't get him indicted, which is with the grand jury a little bit different process and they have 90 days to do that from the date that he was arrested and charged," LaHood started. "Then he gets another shot at getting to go home, possibly."

Brad could also be released if he makes bond during that time. LaHood said that release would be temporary if this case goes to trial.

We requested a copy of the motion for the examining trial from Simpson's lawyer but did not hear back.
