In this video, intellectual property lawyer Steve Vondran discusses a Malibu Media case from the Northern District of California in Judge Alsup courtroom.

In this case (Malibu Media vs. Doe) the Plaintiff Malibu Media sued a "Doe Defendant" by naming only their IP Address. The name of the Defendant is not usually known and a SUBPOENA is sent to the ISP for this purpose.

At any rate, the Defendant (not to pleased with being sued), filed a countersuit for Declaratory Judgement asking the judge to declare that Defendant was NOT a copyright infringer.

Malibu Media then struck back and sought to DISMISS the counterclaim and filed a Motion to Dismiss. Judge Alsup ruled that the motion to dismiss was essentially a "gimmick" to prevent Defendant from being sued in the event they were wrong and the person they were suing DID NOT DOWNLOAD the pornographic adult video.

This is a great case for any Torrent Defense litigator or in pro per Defendant. If they are suing the wrong party, you may be able to FIGHT BACK and the Declaratory Judgement action allows a Defendant to seek attorney fees if the movie company figures out they got it wrong and seeks to dismiss their federal court lawsuit.
