Ok, so in this video we’re talking about why your lawyer won’t give you a straight answer. It’s super frustrating sometimes and I get it. More often than not, it’s because of a few key reasons:

The first reason – chances are, there is not a straightforward answer to your question. That’s why lawyers are famous for answering questions with the same response “IT DEPENDS”

There’s a misconception that the law is static. That there is a black and white rule and you follow it and therefore you can always get a straight answer to a question

But that is not the case. There are so many different factors that go into your lawyer’s answer. For example – the biggest question that a personal injury lawyer gets is ‘how much is my case worth?’ That is a loaded question because there is no simple answer. There are a lot of factors that go into this

a. How severe is your injury?
b. How much insurance is there?
c. How much medical treatment did you undergo?
d. How much are you bills and your lost wages?
e. Who is the judge or how will the jury decide?

And often we get asked this question before the client has finished treating or hasn’t returned to work. It’s just a very difficult question to answer so we answer like lawyers always do – ‘it depends.’

Alright, the 2d reason why you might not be getting a straight answer is that the attorney feels uncomfortable answering the question. I can speak to this from personal experience. I’m on YouTube and I have a website and I get tons of questions and a lot of them I don’t feel comfortable answering. Why? Could be a number of reasons

One of the reasons I am a little uncomfortable answering questions sometimes is that I get asked a question by someone who already has an attorney. This is a touchy subject for a lawyer. If you are already represented by an attorney, then for various reasons, the best place for you to look for answers is your own attorney. Now on this channel, one of my main goals was to give away as much free legal information as I can because I know people need help. But I always recommend if you someone asks me a question and they already have a lawyer to go to the lawyer first.

The third main reason why a lawyer might not give a straight answer is that they’re protecting themselves. Kind of a CYA if you know what I mean.

I get asked questions about every topic but my knowledge is limited to my main practice area – I’m a personal injury attorney. And even that there are a thousand things I don’t know. So some attorneys are hesitant to give out bad information. It may seem like the attorney is stalling or not helpful but they are just protecting themselves.

The other point here is that we live in a seriously litigious society. So giving away free legal information is a scary prospect for attorneys who are trying to keep from getting sued.

The final reason why the lawyer might not answer your question is that – running a law firm is a business. Lawyers get questions asked every day by random people. I get calls every day from people asking legal questions. I don’t represent these people and I usually try to take time to answer their questions but if you’re calling a lawyer who doesn’t represent you and just asking questions – this takes time from their law practice. Which is essentially a business and their goal is to bill hours or make money for their clients not to answer random questions.
