Описание: Recently, the Union Government directed the blocking of access to Telegram under Section 69A of the Information Technology Act, 2000, citing concerns related to national security, public order, and the misuse of the platform for unlawful activities. Telegram challenged the blocking order before the Delhi High Court, arguing that it violates the constitutional guarantee of freedom of speech and expression under Article 19(1)(a).

The controversy has once again brought India's legal framework governing online content, intermediary liability, and internet freedom into the spotlight. Section 69A empowers the Central Government to block online content under specified circumstances, while Section 79 provides intermediaries with "safe harbour" protection subject to due diligence requirements. The debate also revisits the landmark Shreya Singhal (2015) judgment, which struck down Section 66A, and Anuradha Bhasin (2020), which laid down the proportionality test for internet restrictions.
