In this video, I am going to explain in what cases a Gift/ Hiba / Tamleek can be cancelled, if challenged in the court. If Gift is made in favour of legal heirs of donor same is known as Tamleek, you might have heard the word Tamleek Inteqal. The property either gifted by way of Oral Gift Mutation or through Gift Deed, both can be cancelled by civil court, if the court considers that is illegal or based on fraud. Before ordering for cancellation of a gift related to property, the court take into consideration a bundle of things like three ingredients of a valid gift, under what circumstances gift was made, who has been deprived in result of this gift, witness to a gift, their statement, whether gift deed is registered one or not, Patwari or Tehsildar appeared in court or not, and a lot of more things. For cancellation of a gift, a suit for cancellation is filed in civil court and after a lengthy trial; the court passes the order which might be a suit dismissing order or gift canceling order.
