The Speaker of Lok Sabha plays a crucial role in maintaining order and conducting proceedings in the Indian Parliament. But how can the Speaker be removed?
This lecture explains the constitutional procedure for the removal of the Lok Sabha Speaker under the Indian Constitution.
📌 Constitutional Provision
🔹 Article 94 – Deals with vacation, resignation, and removal of the Speaker and Deputy Speaker.
📌 Removal Procedure
1️⃣ The Speaker can be removed by a resolution passed by the Lok Sabha.
2️⃣ The resolution must be passed by a majority of all the then members of the House (Effective Majority).
3️⃣ A 14-day prior notice must be given before moving the resolution.
4️⃣ During the discussion of the removal resolution, the Speaker does not preside over the sitting.
5️⃣ The Speaker can participate and vote in the proceedings (but not in case of equality of votes).
📌 Important Points for Exams
✔ Removal requires Effective Majority, not Special Majority.
✔ Only Lok Sabha can remove its Speaker.
✔ Speaker remains in office until the first meeting of the next Lok Sabha, even after dissolution.
Summary:
The Lok Sabha Speaker can be removed under Article 94 by an effective majority of the House after 14 days’ notice. The Speaker does not preside during the removal proceedings.
