Описание: How can Noida Police register an FIR for a Delhi incident?

That question lies at the heart of a recent case involving allegedly objectionable remarks against the Prime Minister during a Jantar Mantar protest. A complaint was filed in Noida, where police registered a Zero FIR on 29 July and later transferred it to Delhi’s Parliament Street Police Station, which has territorial jurisdiction.

A Zero FIR prevents jurisdiction from becoming an excuse for delaying police action. Section 173(1) of the BNSS, 2023 now expressly allows information about a cognisable offence to be given to a police station “irrespective of the area where the offence is committed.” The jurisdictional police station can subsequently take over the investigation.

The idea existed before BNSS through police practice, judicial developments and recommendations such as those of the Justice Verma Committee; the new criminal law has now given the jurisdiction-neutral principle an explicit statutory basis.

The case also raises a second constitutional debate: where should the line lie between offensive political speech and criminal liability?

Should jurisdiction ever delay the registration of a serious complaint?
