WHAT IS "OBTAINING MONEY BY FALSE PRETENSES" IN NEVADA?
Like it sounds, this Nevada crime outlaws procuring money through deceptive means. For example, NRS 205.380 can be used to prosecute someone who claimed to have an ownership interest in residential property and provided leases to people when in fact the property was in foreclosure by the bank.
The statute could also be used to prosecute a Nevada contractor who agreed to repave a driveway but then does a shoddy job ... the police could then arrest him for obtaining money from the homeowners even though he did defective work.
WHAT ARE THE PENALTIES FOR "OBTAINING MONEY THROUGH FALSE PRETENSES" IN NEVADA?
The penalties depend upon the amount of the alleged misappropriation. If the amount is under $1,200, it is a misdemeanor carrying up to 6 months in jail in Nevada. Otherwise, it is a felony carrying Nevada State Prison.
WHAT ARE DEFENSES TO "OBTAINING MONEY BY FALSE PRETENSES" IN NEVADA?
Often in cases involving obtaining money by false pretenses, Nevada attorneys can negotiate a compromise. Typical settlements involve the defendant agreeing to pay restitution to the alleged victim, and the D.A. agrees either not to press charges or to dismiss charges that have already been filed in Nevada.
